Start your business

Name your business. Use the internet and search the name to check the name availability with The Arizona Corporation Commission. Then purchase a domain name (if you’re wanting a website).

An accountant can provide guidance on tax-related matters, while an attorney can offer advice on matters such as liability, taxes, and other legal concerns. Additionally, the internet hosts a multitude of resources that can be valuable in seeking information. One particularly valuable resource is the  Arizona Commerce Authority Small Business Services.

 

You have several options when it comes to obtaining a name reservation and registering your entity. One option is to visit the A.C.C. website to request a name reservation, or you can visit the Secretary of State’s website to register the name as a trade name. Alternatively, you can submit the necessary paperwork to the A.C.C. to officially form your entity.

It’s important to note that a name reservation through the A.C.C. is valid for only 120 days and serves to “hold” the entity name until you can complete the paperwork to form the entity. On the other hand, registering a trade name with the Secretary of State provides a five-year period of effectiveness. It’s advisable to consult with an attorney regarding the legal considerations involved in obtaining a registered trade name and whether it’s necessary for your specific situation. The A.C.C. cannot provide advice on whether you should pursue a trade name or a name reservation.

If you already have a trade name, obtaining a name reservation is not essential. The trade name itself secures the name for you, allowing you to form an entity as long as you are the owner of the trade name.

To form your entity, you need to submit the appropriate formation paperwork to the A.C.C. For an LLC, you will submit Articles of Organization, while for a corporation, you will submit Articles of Incorporation. The A.C.C. offers online filing options for LLCs, and you can find all the necessary forms and filing options on their website.

Once you submit the formation paperwork, it will be reviewed and approved by A.C.C. staff. If approved, you will receive an approval letter containing additional instructions. If the paperwork is rejected, the letter will provide guidance on how to resubmit it correctly.
